The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency sparked by the introduction of a new 28-article proposal for ending the war appeared – temporarily – to have been defused. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: an extensive attack of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the outgoing year. By day, political struggles are waged: positive announcements are delivered from multiple capitals. Significant resources is devoted on managing particular approaches. By night, Moscow clearly shows the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As the offensive developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was exposed. Ukraine is equipped to monitor missile launches from across the border, a ability enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to engage hostile aerial threats flew past – sophisticated military planes provided to Ukraine by European allies.

Moments later, Kyiv's missile defense activated: several firings fired to intercept a incoming threat. This was a sophisticated defense system at work, probably provided by Western nations. Every firing shakes the surroundings, shaking the windows. The brief panic quickly gives way to grim resignation: maybe the hostile projectile won't cause damage this time, protecting urban areas from devastation and another blackout.

Persistent Threats

Following this, a large-caliber weapon fired at a unmanned aircraft in the vicinity, part of a mobile-fire group – almost certainly imported technology. Unfortunately, the projectiles didn't strike the hostile drone – it continued its flight toward its target.

Intermittently, this persisted until dawn. Kyiv faced the early updates: multiple fatalities, devastation and heating outages in multiple buildings as a result of the evening attack. As always, everyone still continued their routines – experiencing conflict. But those full day illustrated Ukraine's essential dependence on international aid – a reliance that regional partners are demonstrably unable to substitute in the near term.

Ineffective Peace Efforts

The 28-point plan from American leadership generated strong feelings, debate and profound anxiety – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have seen this script before, after prior negotiation attempts and bilateral conferences.

Every new proposal from American administration adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually secure success. This trend will, undoubtedly, endure.

Strategic Calculations

It is convenient to criticize specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. US administration functions according to a principle understood by experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The White House presumes that it is unrealistic to force Russia to surrender the areas that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, American administration does nothing to deter Moscow, through words or deeds, from thinking that the current condition will not change more in its benefit in the coming year.

Divergent Views

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its partners are nearing depletion. Their incentive to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will continue as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but avoiding a complete military breakdown until circumstances change in its favour.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, personal considerations are coming into play: personal goals to negotiate peace and secure international recognition, and Ukrainian leadership's twin challenges – on one hand, not to distance important partners, and on the other, to unite the population around the country's interests against any plan Kyiv finds unacceptable, so that their focus does not move to homefront challenges. And although their task will now be much harder after current events, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a mere seven days to eliminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, recent disclosures, all served their function.

While new proposals based on old ideas are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and reflect certain reluctance to modify developments, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, primarily depend on sustained allied backing.
